The European Court of Justice (ECJ) clarified the legal situation in a decision handed down in 2012 (ECJ, Judgment C-128/11 of 3 July 2012) and subsequent judgements from the German Federal Court (BGH, Judgment I ZR 129/08, of 17 July 2013 and BGH, Judgment I ZR 8/13 of 11 December 2014), and in accordance with Swiss case law (Canton court – KG Zug, ES 2010 822, Executive Order of 4 May 2011), which stated that used software could be resold, regardless of how it was purchased, without requiring permission from the manufacturer.
Provisions of a license agreement that prohibit a subsequent sale are invalid.
